Both programs function as direct cash rebates rather than tax credits, meaning productions receive payment directly from the state after submitting final documentation and completing the audit process. Productions do not need Mississippi tax liability to receive the rebate.

The Motion Picture program has been one of the more consistently active production incentive programs in the Deep South, operating alongside programs in Georgia, Louisiana, and Alabama. Mississippi's combination of competitive rates, a reasonable minimum spend threshold, and a Film Mississippi staff that actively supports productions through the application and audit process has made it a viable choice for independent features, documentaries, and commercial productions.

Motion Picture Program Rebate Rates

  • 25% rebate on all qualifying non-payroll Mississippi expenditures (equipment, locations, services, materials from Mississippi vendors)

  • 25% rebate on non-resident payroll and fringes incurred in Mississippi (up to $5 million per person)

  • 30% rebate on the first $5 million of payroll and fringes paid to Mississippi resident cast and crew

The maximum individual salary eligible for the rebate is $5,000,000 per person. Wages above that threshold are not included in the rebate calculation for either residents or non-residents.

Episodic Television Program Rebate Rates

Mississippi launched a separate incentive pool for episodic series in 2023, providing a dedicated $10 million annual allocation for qualifying episodic productions. This pool is separate from the Motion Picture program's $20 million annual cap, meaning episodic series do not compete with feature film projects for the same funding.

  • 35% rebate on resident crew payroll (up to $3 million per individual per series)

  • 20% rebate on non-resident crew payroll (up to $3 million per individual per series)

  • $10 million annual pool dedicated specifically to episodic television

  • Minimum two episodes required to qualify as an episodic production

The higher resident payroll rate for the episodic program (35%) compared to the motion picture program (30%) reflects Mississippi's intent to encourage episodic series to build local crew relationships and hire resident talent over multiple episodes rather than importing an entirely out-of-state crew for each episode.

Program Caps and Annual Limits

  • Motion Picture program annual cap: $20 million (fiscal year July 1 through June 30)

Productions must apply for and receive a rebate reservation before reaching the per-project cap, as the annual allocation is distributed on a first-come, first-served basis. Once the annual cap for either program is fully committed, no additional reservations are available until the following fiscal year begins on July 1.

Minimum Spend and Eligibility Requirements

  • Minimum qualifying Mississippi spend: $50,000 per project

  • At least 20% of the production crew must be Mississippi residents

  • The production must be fully funded and ready to launch into pre-production at the time of application

  • Application must be submitted before the start of the Mississippi portion of the production

  • Film Mississippi logo credit required in end credits

The 20% crew residency requirement means that productions cannot import 100% of their crew from out of state. At least one in five crew members must be a Mississippi resident. For larger productions with full union crews, meeting this requirement may require active local crew recruitment, which Film Mississippi can assist with through its crew database.

Eligible Production Types

Mississippi's program covers a broad range of production formats:

  • Feature films (theatrical, streaming, and direct-to-video distribution)

  • Television series, pilots, and miniseries

  • Episodic streaming content (at least two episodes)

  • Documentaries (nationally distributed)

  • Short films

  • Commercials for broadcast distribution

  • Music videos

  • Video games (with qualifying Mississippi production activity)

  • Animation and VFX work performed in Mississippi

  • Stand-alone post-production

Distribution requirements apply. Productions must be intended for national or substantial regional distribution to qualify. Purely local or instructional content typically does not meet the nationally distributed threshold.

Qualified Mississippi Expenditures

Qualifying non-payroll expenditures are costs paid directly to Mississippi businesses for production-related goods and services. Key qualifying categories include:

  • Equipment rentals from Mississippi vendors

  • Location fees paid to Mississippi property owners

  • Set construction materials purchased from Mississippi suppliers

  • Catering, craft services, and production supplies from Mississippi vendors

  • Hotel, lodging, and housing allowances for cast and crew on Mississippi production days

  • Local transportation and vehicle rentals from Mississippi businesses

  • Post-production services performed in Mississippi

  • Per diem payments to crew members working in Mississippi

Equipment rented from out-of-state vendors may qualify if rented through a Mississippi production company or vendor that adds an industry-standard markup and has established a staffed local office or contracted with a local representative. Purchases made directly from out-of-state companies without a Mississippi intermediary do not qualify.

Application Process: Step by Step

Film Mississippi recommends applying four to six weeks before any qualifying expenditures will be incurred in the state. The application must be submitted before the production begins its Mississippi activity.

Step 1: Development inquiry. Projects still in development that are not yet fully funded should submit an inquiry through the Film Mississippi website. The office will respond with information on eligibility and timing without committing program funds. Do not apply for the formal rebate until the project is fully funded and ready to move into pre-production.

Step 2: Formal application. Once the project is fully funded and pre-production is imminent, submit the formal application through Film Mississippi. Required submission materials include the full production budget, funding commitments, project description, estimated Mississippi expenditures, and proposed production schedule.

Step 3: MDA review and rebate reservation. Film Mississippi and the MDA's Business Incentives Division review the application and confirm the production meets program requirements. Based on the submitted budget, MDA establishes a maximum rebate figure and reserves that amount from the annual cap. The eligibility date for all qualifying expenses is set as the date Film Mississippi and MDA complete their review.

Step 4: Production and documentation. During the Mississippi production period, track all qualifying expenditures with invoices, payroll records, contracts, and proof of payment. Mississippi residency documentation must be collected for each crew member claimed under the resident payroll rate.

Step 5: Post-production audit. After completing Mississippi production activities, submit a final rebate claim with all supporting documentation. Film Mississippi coordinates a review of all documentation. An independent CPA examination may be required for larger productions.

Step 6: Rebate payment. After the documentation review is completed and verified, MDA processes the rebate payment. The rebate is paid directly to the production company.

Mississippi Resident Documentation

To claim the higher resident payroll rate (30% Motion Picture, 35% Episodic), each qualifying crew member must be a Mississippi resident whose wages are subject to Mississippi income tax withholding. The production must collect documentation of residency, typically a Mississippi driver's license or state ID, and ensure that Mississippi income tax withholding is applied to those individuals' wages during the production period. Loan-out company payments require additional documentation to confirm the underlying individual is a Mississippi resident.

Mississippi Military Veteran Uplift

An additional 5% rebate is available on payroll paid to Mississippi resident cast or crew members who are honorably discharged veterans of the US Armed Forces. To claim this uplift, the production must obtain documentation of the individual's veteran status and Mississippi residency. Given Mississippi's significant military veteran population, productions that actively recruit from veteran networks in the state can generate a meaningful additional return on those crew members' wages.

Mississippi Filming Locations

Mississippi offers a range of distinctive settings that serve production needs across genres and formats:

Antebellum architecture and plantation settings. Mississippi has a significant concentration of antebellum architecture, including plantation houses, Greek Revival mansions, and period-appropriate outbuildings in the Natchez, Port Gibson, and Columbus areas. These settings are sought by period productions set in the 19th and early 20th century American South.

Mississippi Delta. The flat agricultural landscape of the Delta, running from Memphis south to Vicksburg, has a raw, authentic quality tied to blues music history, agricultural labor heritage, and small-town Delta culture. Clarksdale and Greenville are among the towns with filming-accessible environments and established connections to the entertainment industry through their blues heritage.

Gulf Coast. The Mississippi Gulf Coast, including Biloxi, Gulfport, and Bay St. Louis, offers beach and waterfront settings, casino resort architecture, and a post-Katrina rebuilt coastal landscape that has its own visual character. Biloxi in particular has been used for productions that need a non-Florida Southern beach environment.

Jackson. The state capital has downtown office architecture, the Mississippi State Capitol building, residential neighborhoods, and urban locations that serve contemporary narrative productions. Jackson's civil rights history also makes it a destination for documentary and historical drama production.

Natchez. Among the most historically intact small cities in the country, Natchez on the Mississippi River bluff offers extraordinary concentrations of antebellum architecture, a historic downtown, and river views that are exceptional for period production.

Separate episodic pool. The $10 million episodic-specific annual pool means that a series production does not need to compete for the same funding as feature films. No minimum filming days required. Mississippi does not require a minimum number of shooting days in the state, only that qualifying expenditures meet the $50,000 minimum.
